Enrolment is conditional upon:
* the information which is supplied by the applicant to the Association upon which an offer of a place in a course is based, being accurate;
* the approval of the Registrar or Executive Director (or his/her nominee) of the subjects concerned;
These are the details and conditions of enrolment as at January 2005. The student should keep a copy for his or her reference.
(A) The Marketing Association of Australia and New Zealand Incorporated (The Marketing Association) offers a number of courses of study, plus individual subjects. The student wishes to enroll in subjects as indicated on the application
(B) The student desires to undertake the course or subject(s) referred to in their application.
(C) The Marketing Association has been requested by the student to accept his or her enrolment subject to the terms and conditions as herewith appearing.
(D) The period of this enrolment is for the period of the subject(s) described in the course brochure or handbook.
(E) The Marketing Association of ANZ may refuse to accept any application for enrolment at its own discretion and is not obligated to provide any explanation.
If the application is accepted
The parties agree:
1. As a Student Member the student agrees to abide by and act in accord with the Rules of Membership of the Marketing Association.
2. The student shall and will at all times during the Course diligently apply himself or herself to the study of the Course or any single subjects and will obey all lawful directions in all things concerned with the Course.
3. The student will conduct himself or herself with propriety and in all respects conform to the arrangements and rules of the Course.
4. If at any time the Marketing Association shall be dissatisfied with the conduct or diligence of the student it may suspend the student or, after giving 7 (seven) days notice in writing to the student, determine this agreement and will not be required to make repayment of any part of the payments made by the student in respect to subject or subjects the student is enrolled in.
5. The Fees are $250.00 per subject (e.g. 2 x subjects = $500.00) - The student agrees to pay all course fees when due. (14 days from invoice)
6. Fees may be subject to change after 30 days written notice.
7. A full refund of fees is payable if the Association is notified (in writing) up to 7 days prior to commencement of the course or subject.
8. Students with outstanding fees or other charges, may be suspended from class, and/or examinations, and shall not receive results of examinations or assignments at the discretion of the Marketing Association, until such fees have been paid.
9. The Marketing Association reserves the right to make amendments, alter, cancel or postpone the Course or any subjects in the Course.
10. The Marketing Association will in the event of cancellation of the Course or subject, refund a proportionate part of the subject fees corresponding to the subject(s) as set out in the Subject Guide
11. The Marketing Association reserves the right to make amendments to the Course or any subjects forming part of the course for the purpose of improving the content or tuition of the Course.
12. All books, notes and other materials supplied shall remain the property of the Association until all course or subject fees have been paid.
13. Notwithstanding that the student has not completed an application, but has been formally offered enrolment in the terms and conditions contained herein, and has commenced the course or subject(s), such commencement shall be taken as an acceptance of the terms and conditions of enrolment as set out in this document.
14. The provisions and agreements contained in this Agreement will be regarded as separate distinct and several each one from the other so that the invalidity of any one or more of such provisions or agreements shall in no way affect the enforceability of any other such provision or agreement.
Course Notes.
15. All notes and other written material supplied as part of any subject or course of study is provided only for the purpose of study. It is provided only to the student it has been sent to. Except for the purpose of study, all notes remain copyright and the property of the Marketing Association of Australia and New Zealand Incorporated. Notes may not be copied in any form or transferred to any other party without our specific, written consent.
16. Upon acceptance of a student's application to enroll, the Registrar or Executive Director shall notify the student in writing, by way of an email, or letter and invoice.
17. Applicants shall have7 days to notify the Association of any changes to their application or enrolment. After this time the student is considered to have been formally enrolled.
18. Students are required to provide as proof of their prior learning or qualifications.
General Terms of Use of Notes and other Materials
1. By reading or using any part of the notes provided by MAANZ or any of its partners or servants, you indicate that you have read, understand, agree to and accept all the terms of this license and intellectual property (trademark/copyright) agreement. If you do not agree to abide by all the terms of this agreement, you must cease using and return or destroy all copies such works in your possession.
2. If you paid a fee pertaining to such notes or works and you do not agree to be bound by the terms of this agreement, you may obtain a refund from the person or entity to whom you paid the fee.

MAANZ suppliers, partners, volunteers and employees expend considerable effort to create, research, transcribe and proofread material and works in creating the works and materials provided with subjects and courses. Despite these efforts, MAANZ works, and the medium on which they may be stored, may contain "Defects," such as, but not limited to, incomplete, inaccurate or corrupt data, transcription errors, a copyright or other intellectual property infringement, a defective or damaged disk or other medium, a computer virus, or computer codes that damage or cannot be read by your equipment.

LIMITED WARRANTY, DISCLAIMER OF DAMAGES - Except for the "Right of Replacement or Refund" described below, the Marketing Association of Australia and New Zealand Incorporated and any other party distributing a work or other materials under this agreement, disclaim all liability to you for damages, costs and expenses, including legal fees. YOU AGREE THAT YOU HAVE NO REMEDIES FOR NEGLIGENCE, STRICT LIABILITY, BREACH OF WARRANTY OR BREACH OF CONTRACT EXCEPT THOSE PROVIDED IN PARAGRAPH F3. YOU AGREE THAT THE FOUNDATION, THE TRADEMARK OWNER, AND ANY DISTRIBUTOR UNDER THIS AGREEMENT WILL NOT BE LIABLE TO YOU FOR ACTUAL, DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES EVEN IF YOU GIVE NOTICE OF THE POSSIBILITY OF SUCH DAMAGE.

5. LIMITED RIGHT OF REPLACEMENT OR REFUND - If you discover a defect in any work or materials within 30 days of receiving it, you can receive a refund of the money (if any) you paid for it by sending a written explanation to MAANZ or the person or organisation you received the work from. If you received the work on a physical medium, you must return the medium with your written explanation. The person or entity that provided you with the defective work may elect to provide a replacement copy in lieu of a refund. If you received the work electronically, the person or entity providing it to you may choose to give you a second opportunity to receive the work electronically in lieu of a refund. If the second copy is also defective, you may demand a refund in writing without further opportunities to fix the problem.

6. Except for the limited right of replacement or refund set forth, this work is provided to you 'AS-IS', WITH NO OTHER WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR ANY PURPOSE.

7. Some countries and states do not allow disclaimers of certain implied warranties or the exclusion or limitation of certain types of damages. If any disclaimer or limitation set forth in this agreement violates the law of the state applicable to this agreement, the agreement shall be interpreted to make the maximum disclaimer or limitation permitted by the applicable state law. The invalidity or unenforceability of any provision of this agreement shall not void the remaining provisions.

8. INDEMNITY - You agree to indemnify and hold the Association, any agent or employee of the Association anyone providing copies of the works and materials in accordance with this agreement, and any volunteers associated with the production, promotion and distribution of Association works or materials, harmless from all liability, costs and expenses, including legal fees, that arise directly or indirectly from any of the following which you do or cause to occur: (a) distribution of this or any work, (b) alteration, modification, or additions or deletions to any The Marketing Association of Australia and New Zealand Incorporated work, and (c) any Defect you cause.
